Terms of Use & License Agreement

These Terms of Use ("Terms") are a legal agreement between you and Eternal Pulse Apps ("we," "us") governing your use of the MacroDine app ("the app"). By downloading or using the app, you agree to these Terms. If you do not agree, do not use the app.

1. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the app on Apple devices that you own or control, as permitted by the Apple Media Services Terms and Conditions. You may not copy, modify, reverse-engineer, or redistribute the app except as allowed by law.

2. Not medical or dietary advice

MacroDine provides general nutrition information, estimates, and suggestions to help you make choices while eating out. It is not medical, nutritional, or professional advice, and it is not a substitute for consultation with a qualified professional. Nutrition needs vary by individual. If you have a medical condition, dietary restriction, allergy, or take medication (including GLP-1 medications), consult a qualified healthcare or nutrition professional before relying on the app. You use the app's recommendations at your own discretion and risk.

3. Accuracy of nutrition data

Chain nutrition data is compiled from publicly available sources and is provided "as is." Restaurant recipes, portions, and values change and may differ by location; we do not guarantee accuracy or completeness. Values produced by Menu Scan are AI-generated estimates and are labeled as such; they may be inaccurate. Always verify against official sources and your own judgment.

3a. Provider warning

Always follow allergen and safety guidance provided directly by the restaurant. Do not rely on the app for allergy, intolerance, or other safety-critical decisions.

4. Subscriptions, billing & trials

MacroDine offers an optional auto-renewable subscription ("Premium") in the following plans:

Payment is charged to your Apple Account at confirmation of purchase. Subscriptions renew automatically for the same period at the same price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends. If you start a free trial and purchase before it ends, any unused portion of the trial is forfeited. You can manage or cancel your subscription in your Apple Account settings after purchase. Prices are in U.S. dollars and may vary by region or change over time. Refunds are handled by Apple in accordance with Apple's policies; we cannot issue refunds directly.

5. Acceptable use

You agree to use the app only for lawful personal purposes and not to misuse it, interfere with its operation, or attempt to access it in unauthorized ways. Use Menu Scan only on menus and avoid capturing other people or their personal information.

6. Disclaimer of warranties

The app is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or accurate.

7. Limitation of liability

To the maximum extent permitted by law, Eternal Pulse Apps will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of or reliance on the app, including dietary or health outcomes. Our total liability for any claim relating to the app will not exceed the amount you paid us for the app in the twelve months before the claim.

8. Apple as third-party beneficiary

These Terms are between you and Eternal Pulse Apps only, not Apple. Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. In the event the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the app, including product liability, legal or regulatory compliance, or consumer protection claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

9. Changes to these Terms

We may update these Terms as the app evolves. Continued use after changes take effect constitutes acceptance. The "Last updated" date above reflects the current version.

10. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules, and subject to any mandatory consumer-protection rights in your country of residence. Subject to those rights, you agree to the exclusive jurisdiction of the courts located in Ontario, Canada for any dispute arising out of or relating to these Terms or the app.
